How a Foreign Spouse Can Get OCI in India: Our Experience & Guide

So in this guide, we want to share our experience along with the current OCI requirements to help other Indian–foreigner couples understand the process, documents and things they should prepare before applying.

What is OCI and Who Can Apply
OCI stands for Overseas Citizen of India. It is a special immigration status for eligible foreign nationals, including the foreign spouse of an Indian citizen.
For a foreign spouse, one of the most important requirements is that the marriage must be legally registered and must have continued for at least two continuous years immediately before the OCI application. Spouse-based applications are also subject to security clearance.
OCI is not Indian citizenship. An OCI holder remains a foreign citizen and continues to use their foreign passport.
OCI provides a lifelong multiple-entry visa facility for India, along with certain benefits similar to those available to NRIs, but there are also restrictions on voting, certain government positions, some professional activities and agricultural property.
Our Experience with the 2-Year Marriage Requirement
When we applied for my wife's OCI, we had already completed the required two years of our registered marriage.
This is something you should check before starting the application. Your marriage needs to be officially registered, and the two-year period is counted from the registered marriage.
If you have recently got married, you generally cannot apply immediately under the foreign-spouse category.
The 6-Month Stay Update You Should Know
This is one of the biggest changes compared with when we applied.
When we applied, we were told that the foreign spouse had to stay continuously in India for six months (180 days) before submitting the OCI application. This was part of the instructions we received at the time.
However, the current Government of India OCI portal specifically says that eligible foreign nationals applying through their jurisdictional FRRO in India do not need to stay continuously in India for six months.
So if you find older websites saying that you must first complete 180 days in India, be careful. That six-month continuous-stay requirement is no longer applicable to an eligible applicant applying through the FRRO in India.
There is still a six-month definition of "ordinarily resident" in the OCI rules, but the current portal explains that this applies to foreign nationals applying from a third country other than their own country.

What Visa Does the Foreign Spouse Need?
If you are applying for OCI while in India, you need the appropriate long-duration Indian visa and the applicable Residential Permit/Registration Certificate.
The current OCI rules do not allow a foreigner to apply for OCI from India while holding a Tourist, Missionary or Mountaineering Visa.
So make sure your immigration status is correct before starting the application.
Documents You Should Prepare for OCI Application in India
The exact documents can depend on your circumstances and the FRRO where you apply. When we applied through FRRO Mumbai, we prepared documents for both of us separately, along with our marriage documents.
Documents for the Indian Spouse
Current valid foreign passport
All previous/expired passports, especially those containing previous Indian visas or immigration records
Birth certificate of the foreign spouse apostilled by Foreign ministry of applicants country
Birth certificates of the foreign spouse's parents (They mentioned it in the email, but they didn’t take copies from us. They only took our parents’ passports)
Valid Indian long-duration visa
Residential Permit / Registration Certificate, where applicable
C-Form along with proof of residence
Proof of address in India, such as an accepted utility bill or rental document (Rent agreement & Electricity/Gas bill is enough)
Recent photograph according to the current OCI specifications
Digital signature
Proof of current citizenship/naturalization, where applicable
Self-declaration form, where required
Divorce decree, if the foreign spouse was previously married
Military/conscription documents, if applicable
Any other supporting documents requested during verification
Documents for the Foreign Spouse
Valid Indian passport (Add Foreign spouse name on passport)
Proof of Indian citizenship (Domicile/Nationality Certificate)
Documents proving Indian origin/citizenship of the Indian spouse's parent (We submitted domicile certificates)
If the Indian spouse is an OCI cardholder rather than an Indian citizen, their OCI card and the documents on which their OCI was issued
Documents relating to a previous marriage/divorce, if applicable
Any additional documents requested by the FRRO
Marriage Documents
Registered Marriage Certificate (Indian court marriage certificate is best)
The marriage must have been registered and continuously subsisting for at least 2 years immediately before applying
If the marriage was registered outside India, the Marriage Certificate may need apostille or the applicable authentication
If the Marriage Certificate is not in English, an authorized English translation may be required
A few things we were asked for
During our own application, we were also asked to bring previous passports, originals and photocopies of documents, and both of us had to be physically present for the process.
We were also asked to make sure my wife's name was reflected in my Indian passport's family details. These practical requirements can vary by FRRO, so we recommend checking with your jurisdictional FRRO before your appointment.
It is also a good idea to carry additional supporting documents if you have them. FRRO authorities can ask for additional documents depending on the individual case.
The Online Application and FRRO Process
The OCI application starts online on the official government portal. You fill in details, upload scanned documents, and pay the fee. After submitting, you book an appointment at your jurisdictional FRRO office in India.
At the FRRO, the process includes:
Document verification
Personal interview with both spouses (in our case)
Biometrics capture (fingerprints and photo)
And wait :)......3 to 6 Months
The current fee for OCI card for foreigner spouses is around INR 15,000, but check the official site as fees can change.
Processing time varies but expect about 6 to 8 weeks from the date of submission at FRRO. We found the process smooth once we had all documents ready and attended the interview together.
Major Benefits of OCI for Foreign Spouse
Having an OCI card for foreign wife or husband in India opens many doors:
Multiple entry, multi-purpose lifelong visa to India
No need for visa renewal or registration with FRRO for stays over 180 days
Ability to work, study, and own property in India (with some restrictions)
Access to many government schemes similar to NRIs
For us, the biggest relief was no longer worrying about visa renewals and the freedom to live and work in India without hassle.

Tips from Our Experience
Keep your registered Marriage Certificate safe.
Keep both current and previous passports ready.
Carry original documents and copies if your FRRO asks for them.
Make sure your foreign spouse has the correct Indian visa.
Check your Residential Permit/FRRO documents.
Both spouses should be prepared to attend the interview.
Keep additional supporting documents ready.
Don't rely on old OCI information, especially regarding the six-month stay and application fee.
Always check the latest official OCI requirements before applying.
Final Thoughts
Getting OCI for a foreign wife or husband can look complicated at first, but once you understand the process and prepare the documents properly, it becomes much easier.
For us, the most important thing was simply being prepared and making sure all our documents were in order.
And remember the biggest update: if an eligible foreign spouse is applying through their jurisdictional FRRO in India, they no longer need to stay continuously in India for six months before applying.
